I've been working as a casual for nearly 5 years, 9-5, Monday to Friday in the same position.

They are looking to move me to a fixed term employment contract and have indicated that this prior service will not be counted towards long service leave. Do I have an argument that it should given the below quote from their EBA?

"All other Staff Members will accrue LSL on completion of 10 years Continuous Service (including any recognition of prior service) and after each subsequent period of 7 years Continuous Service."

Generally long service leave is paid to employees who have worked continuously in a business for a specified period of time whether they are full time, part time or casual.

Check out the WA Dept of Commerce re this: Long service leave

There is a process for contacting the Fair Work Infoline and checking long service leave entitlements here: Welcome to the Fair Work Ombudsman website
