Hi,

Just a quick question.

When preparing an initiating application to vary existing consent orders, can the original affidavit with the relationship timeline be attached as an annexure so you don't repeat past information? Or should there still be a section containing the background and origins of the relationship?

As in, the affidavit from the first case starts from when the parents commenced dating. Does the new affidavit need to go back this far?

I've never had to file an initiating application to vary orders, but if it were me in the position, I would just include the information in a new affidavit, rather than annexing the existing affidavit.

If anything from the original affidavit needs to be in the new affidavit, it should be within the body of the affidavit not as an annexures.
